New York—McGraw-Hill Cos. has filed a motion to dismiss five counts of a complaint filed in October by Reed Construction Data that alleged McGraw-Hill had engaged in corporate spying against it.
In the court filing, McGraw-Hill's attorneys wrote, "RCD's complaint is a model of exaggeration and over-pleading.” McGraw-Hill moved to dismiss count three (misappropriation of confidential information); count five (tortious interference with prospective economic advantage); count six (violation of New York General Business Law); count seven (violation of the Racketeer Influenced and Corrupt Organizations Act); and count eight (conspiracy to violate RICO).
In the filing, McGraw-Hill didn't move to dismiss count one (fraud); count two (misappropriation of trade secrets); count four (unfair competition); count nine (monopolization); count 10 (attempted monopolization); and count 11 (unjust enrichment).
"We will address the remaining claims in our response to the lawsuit," a McGraw-Hill spokesperson said. RCD declined to comment on McGraw-Hill's filing.
